Where businesses use third parties to collect, store and process personal data, controller-processor relationships are very common. While the data controller determines the purposes and means of the processing of personal data, the processor processes the personal data on behalf of the controller. A data processing agreement is a legal requirement and establishes the legal basis for such processing, contractually ensures that the rights of data subjects are observed, and contains specific instructions about the processing.
Data processing covers a wide range of operations performed on personal data and includes manual or automated collection, structuring, storage, use, and erasure. As soon as personal data is not processed by the same organization which controls the data (e.g., a SaaS-provider as controller uses cloud services of a third-party processor to store and organize personal data), a written agreement must regulate the particularities of such data processing.
Every document which forms part of the LEXR Standard is based on market best practices and then continuously improved with legal professionals and customers to keep the document updated when there are any changes to the law or market standards.
The Data Processing Agreement used for this DPA Generator is based on the draft Data Processing Agreement by the European Commission. It was reviewed by multiple data protection experts and refined to reflect best practices as well as the requirements of the Swiss Federal Act on Data Protection.
While LEXR Bridge can easily be used adjusted to generate any of your business’s legal documents with a simple questionnaire, it can also do much more than that. Neither does the data input have to come (exclusively or at all) from direct user interaction, nor are you limited to the simple file output. Imagine a process, triggered by any software-based event you like, and ending with a database entry, an automated email, or a request for signature.
